US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to answer alien smuggling charges, he was held in federal custody.
In her order, the court noted that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
